1. Acceptance of terms
By downloading, installing, or using the EDGE Performance mobile application and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and EDGE Performance Club Ltd ("EDGE", "we", "us", or "our").
2. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and 18, you must have the consent of a parent or legal guardian, who will also be bound by these Terms.
By using the Service, you represent and warrant that you have the legal capacity to enter into a binding agreement and that all information you provide is accurate and complete.
3. Accounts & registration
To access the Service you must create an account. You agree to:
- Provide accurate, current, and complete registration information.
- Maintain and promptly update your account information.
- Keep your password confidential and not share it with any third party.
- Notify us immediately at hello@edgeperformanceclub.com if you suspect unauthorised access to your account.
- Accept responsibility for all activities that occur under your account.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Subscriptions & in-app purchases
Subscription plans
EDGE Performance offers auto-renewing subscription plans (e.g. monthly, annual) that unlock premium features. Subscriptions are processed through Apple App Store (iOS) or Google Play Store (Android) and are subject to those platforms' payment terms.
Billing & renewal
- Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the current period ends.
- Your payment method will be charged within 24 hours prior to the renewal date.
- Subscription prices may change; we will provide reasonable notice before any price increase takes effect.
Cancellation
You may cancel your subscription at any time through your device's account settings (App Store or Google Play). Cancellation takes effect at the end of the current billing period — you will retain access to premium features until that date. No partial refunds are provided for unused time within a billing period, except where required by applicable law.
Statutory cooling-off right (UK & EU consumers)
If you are a consumer in the UK or EU, you have a statutory right to cancel a new subscription within 14 days of purchase under the Consumer Contracts Regulations 2013 (UK) or the Consumer Rights Directive (EU). If you request access to the Service during this 14-day period and then cancel, you may be charged a pro-rata amount for the period of use. To exercise this right, contact us at hello@edgeperformanceclub.com before the 14-day period expires. Where subscriptions are processed via Apple App Store or Google Play, cancellation and refund requests must be made through those platforms in accordance with their policies.
Refunds
All purchase and refund disputes are handled by Apple or Google under their respective policies. EDGE Performance does not process refunds directly. To request a refund, use Apple's "Report a Problem" tool or Google Play's refund request process. Nothing in these Terms affects your statutory refund rights as a consumer.
Free trials
Where a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless cancelled before the trial expires.
5. Acceptable use
You agree to use the Service only for lawful purposes and in compliance with these Terms. You must not:
- Upload, transmit, or share content that is unlawful, defamatory, obscene, or infringes any third party's rights.
- Attempt to gain unauthorised access to the Service, its servers, or any connected systems.
- Use automated tools (bots, scrapers, crawlers) to access or collect data from the Service without our written permission.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the application.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to transmit spam, malware, or any harmful code.
- Create multiple accounts to circumvent access restrictions or subscription requirements.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Violations of this section may result in immediate termination of your account and, where applicable, legal action.
6. Health & medical disclaimer
EDGE Performance is a fitness tracking and analytics tool. It is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment.
The information, insights, and recommendations provided by the Service (including AI-generated coaching content) are for informational and educational purposes only. They do not replace professional medical advice, diagnosis, or treatment from a qualified healthcare provider, sports physician, or certified coach.
Always consult a qualified healthcare professional before making changes to your training programme, nutrition, or recovery protocols, particularly if you have a pre-existing medical condition or injury. Never disregard or delay seeking professional medical advice based on information from the Service.
EDGE Performance is not responsible for any injury, health issue, or adverse outcome resulting from reliance on information provided by the Service.
7. User content & uploads
You may upload content to the Service, including profile photos, video files, and wellness entries ("User Content"). By uploading User Content, you:
- Represent that you own or have the necessary rights to upload the content.
- Grant EDGE a limited, non-exclusive, royalty-free licence to store, process, and display your User Content solely to provide the Service to you.
- Confirm that your User Content does not infringe any third party's intellectual property, privacy, or other rights.
We do not claim ownership of your User Content. We will not use it for advertising, training AI models, or any purpose beyond providing the Service without your explicit consent.
Video files uploaded for analysis are stored temporarily (up to 90 days) and used only for the computer-vision analysis features you request. You may delete uploaded files at any time.
8. Third-party integrations
The Service integrates with third-party platforms including WHOOP, Apple Health, ReSpo Vision, and football data providers. Your use of these integrations is also subject to the respective third party's own terms of service and privacy policies.
We are not responsible for the availability, accuracy, or content of third-party services. We do not guarantee that integrations will remain available, and we may discontinue or modify them at any time.
You are responsible for maintaining authorised access to any third-party account you connect to EDGE Performance.
9. Intellectual property
All rights, title, and interest in and to the Service — including its design, codebase, algorithms, AI-powered features, brand, and all content created by EDGE — are owned by EDGE Performance Club Ltd or its licensors and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or sublicence any part of the Service.
"EDGE", "EDGE Performance", and "EDGE Academy" are trademarks of EDGE Performance Club Ltd. You may not use them without our prior written consent.
10. Termination
You may stop using the Service and delete your account at any time via Settings › Account › Delete Account.
We may suspend or terminate your access to the Service at any time, with or without notice, if:
- You violate these Terms or our Acceptable Use policy.
- We are required to do so by law.
- We discontinue the Service (we will provide reasonable advance notice).
Upon termination, your licence to use the Service ends immediately. Sections 6, 9, 11, 12, and 13 survive termination.
11. Disclaimer & limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EDGE PERFORMANCE CLUB LTD SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of data, profits, revenue, goodwill, or business opportunities.
- Damages arising from your use of or inability to use the Service.
- Inaccuracies in data synced from third-party wearables or services.
- Any health, fitness, or safety outcomes resulting from use of the Service.
Our total aggregate liability to you for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or £50 (whichever is greater).
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless EDGE Performance Club Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service in violation of these Terms; (b) your User Content; or (c) your violation of any third party's rights.
13. Governing law & disputes
These Terms and any dispute arising out of or in connection with them (including non-contractual disputes) are governed by and construed in accordance with the laws of England and Wales.
Any dispute shall first be referred to informal negotiation. If unresolved within 30 days, both parties submit to the exclusive jurisdiction of the courts of England and Wales.
Nothing in this clause affects any statutory rights you may have as a consumer under applicable consumer protection laws.
14. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will notify you via email or in-app notification at least 14 days before the new Terms take effect. The "Last updated" date at the top of this page will reflect the latest revision.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
15. Severability & entire agreement
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy and any additional terms presented to you within the Service, constitute the entire agreement between you and EDGE Performance Club Ltd regarding your use of the Service and supersede all prior agreements or understandings relating to the same subject matter.
